"Preamble: This Family Charter is a non-binding statement of principles voluntarily adopted by the members of the [XX Family]. It is not a contract, does not create legally enforceable rights or obligations, and is not intended to govern the legal interpretation of any other family document including any Settlement Deed, Shareholder Agreement, Prenuptial Agreement, Letter of Wishes, or testamentary instrument.
Article I (Mission): The XX Family endeavors to (a) preserve and grow the family wealth across generations through prudent stewardship; (b) cultivate individual excellence and contribution in each family member; (c) contribute to the broader community through philanthropy and responsible business conduct.
Article II (Family Membership): A "Family Member" includes all lineal descendants of [Founder], their spouses (during the subsistence of the marriage), adopted children, and any individual recognized by majority of the Family Council. The Charter does not discriminate based on gender, sexual orientation, religion, or nationality, save where applicable law requires otherwise.
Article III (Family Council): A Family Council shall convene at least annually, with each adult Family Member entitled to one vote. The Family Council elects a Chair for a two-year term and oversees the implementation of this Charter.
Article IV (Wealth Principles): The Family aspires to follow these wealth principles: (a) capital is held in stewardship for future generations and not for present consumption beyond reasonable need; (b) employment in family businesses requires merit; (c) family loans and gifts between members are documented and repayable; (d) charitable giving constitutes a minimum aspirational 5% of after-tax family income.
Article V (Education and Career): The Family Council encourages each Family Member to pursue education and career consistent with individual interests, with the Family providing reasonable support for higher education through trust distributions or family office programs as outlined separately.
Article VI (Conflict Resolution): Conflicts among Family Members shall first be addressed by direct discussion, then by mediated dialogue facilitated by an independent family advisor, and finally by the Family Council. The Family Council shall not arbitrate legal disputes; legal recourse remains available to all Members.
Article VII (Amendment): This Charter may be amended by two-thirds majority of voting Family Members at any Family Council meeting, provided written notice of proposed amendments has been circulated 30 days in advance.
Article VIII (Closing): This Charter expresses the shared aspirations of the XX Family as of [date] and is intended to be revisited every five years by the Family Council. Signature below indicates voluntary acceptance of these aspirational principles, but does not create any legal obligation."
